Plain English Summary

Use SeraphVPN to protect your privacy. Don't abuse the network. We don't limit your usage, but we will suspend accounts that damage our infrastructure. Be reasonable, and we'll take care of you.

1. Agreement to Terms

By creating an account or using SeraphVPN (the "Service"), you agree to these Terms of Service ("Terms"). If you don't agree, please don't use the Service.

These Terms form a legal agreement between you and SeraphVPN. Read them carefully.


2. Service Description

SeraphVPN provides:

  • Encrypted VPN access — Secure tunneling using post-quantum cryptography (PALISADE protocol)
  • Privacy protection — No-logs policy (see our Privacy Policy)
  • Unlimited usage — We don't track, limit, or throttle based on usage quantity
  • Multiple device support — Connect multiple devices simultaneously (based on your plan)
  • Global server network — Access to our VPN servers worldwide

3. No Usage Limits

We do not track, measure, or limit the quantity of your VPN usage. There are no bandwidth caps, data limits, or usage quotas. Use the VPN as much as you need—that's the point.

However, this unlimited policy assumes reasonable, good-faith use. If your usage damages our network infrastructure or degrades service for other users (see Section 5), we reserve the right to take action.


4. Account Registration and Security

To use SeraphVPN, you must:

  • Be at least 18 years old
  • Provide a valid email address
  • Create a secure password
  • Maintain the confidentiality of your account credentials

You are responsible for all activity under your account. If you suspect unauthorized access, contact us immediately at Henry@seraphvpn.com.

4.1 Device Keys Are Not Shareable

Please don't share your device access keys with others. Beyond being against our Terms, it technically won't work—and here's why:

How Device Keys Work (Important!)

SeraphVPN uses per-device cryptographic keys for security. If the same key appears in multiple locations simultaneously, our system interprets this as a security issue—like someone stole your key.

What happens automatically:

  • The system detects the same device key being used from different locations
  • It assumes the key was compromised (for your protection)
  • The key is automatically revoked on all devices using it
  • Service stops working until you re-authenticate with a fresh key

This is a security feature, not a punishment—it's designed to protect you if someone actually steals your credentials.

The technical reason: PALISADE uses per-device cryptographic keys tied to specific device identities. When our system sees the same key from different IP addresses or conflicting connection states, it can't tell the difference between "user shared their key" and "key was stolen," so it revokes the key to be safe.

Why this is actually good:

  • Security — If someone steals your key, it's detected and revoked immediately
  • Privacy — Per-device keys prevent tracking you across devices
  • Integrity — Ensures each connection is authentic

If you need multiple devices: No problem! Your subscription includes multiple device slots. Just log in to each device separately with your email and password, and each device gets its own unique key. This works perfectly and triggers no security alerts.

Summary: Sharing keys breaks service for technical reasons (our security system thinks it's a compromise), so just use the proper multi-device support instead. It's easier and actually works.


5. Acceptable Use Policy

We built SeraphVPN to protect your privacy, not to enable abuse. You agree to use the Service responsibly and legally.

5.1 Prohibited Activities

You may NOT use SeraphVPN for:

  • Illegal activities — Activities that violate applicable laws in your jurisdiction or ours
  • Sharing device keys — Don't share your device credentials with others (see Section 4.1—it won't work anyway due to our security system)
  • Network attacks — DDoS attacks, port scanning, penetration testing without authorization, or any activity that damages networks or systems
  • Malware distribution — Distributing viruses, ransomware, trojans, or other malicious software
  • Spam or phishing — Sending unsolicited bulk email or impersonating others to steal credentials
  • Copyright infringement — We don't monitor your traffic, but you're responsible for complying with copyright laws
  • Child exploitation — Any activity involving child sexual abuse material (CSAM) will result in immediate termination and reporting to authorities
  • Infrastructure abuse — Activities that degrade service quality for other users or damage our network infrastructure

5.2 Network-Damaging Behavior

Examples of behavior that can damage our network and violate these Terms:

  • Running high-volume automated scripts that saturate server connections
  • Attempting to bypass security measures or exploit vulnerabilities
  • Using the VPN as infrastructure for attacks on third parties
  • Deliberately generating excessive connections to exhaust server resources

To be clear: Normal high-bandwidth use (streaming, downloads, etc.) is fine. We mean abuse that targets the infrastructure itself.

5.3 Consequences of Violation

If you violate this Acceptable Use Policy, we reserve the right to:

  • Issue a warning — For first-time or minor violations
  • Temporarily suspend access — While we investigate the issue
  • Permanently terminate your account — For serious or repeated violations
  • Report to authorities — If required by law (e.g., CSAM, terrorism)
  • Refuse refunds — For accounts terminated due to Terms violations

We don't monitor your traffic (see our Privacy Policy), but we can detect network-level abuse patterns. If we suspend your account, we'll notify you via email with an explanation unless prohibited by law.


6. Subscription Plans and Billing

6.1 Payment

  • All subscriptions are billed in advance
  • Payment is processed securely through Stripe (we never see your card details)
  • Prices are displayed in USD and include applicable taxes where required
  • You authorize us to charge your payment method for the subscription amount

6.2 Automatic Renewal

Subscriptions automatically renew at the end of each billing period (monthly or annual) unless you cancel before the renewal date. You'll be charged the then-current subscription price.

You can cancel renewal at any time from your account dashboard. Cancellation takes effect at the end of your current billing period—you keep access until then.

6.3 Price Changes

We may change subscription prices with at least 30 days' notice. Price changes apply to renewals after the notice period. If you don't accept a price increase, you can cancel before it takes effect.

6.4 Refund Policy

  • 30-day money-back guarantee — Full refund if you cancel within 30 days of your initial purchase
  • Pro-rated refunds — Not available after the 30-day period (you can cancel to avoid future charges)
  • Violations — No refunds for accounts terminated due to Terms violations

6.5 Failed Payments

If a payment fails (expired card, insufficient funds), we'll notify you and attempt to charge again. If payment continues to fail, your account will be suspended until payment is successful.


7. Account Suspension and Termination

7.1 Our Right to Suspend or Terminate

We reserve the right to suspend or terminate your account, with or without notice, if:

  • You violate these Terms
  • Your usage damages our network infrastructure
  • Your account is used for prohibited activities (Section 5)
  • We're legally required to terminate access
  • Payment fails and isn't resolved

We'll generally provide notice and an opportunity to remedy the issue, except for serious violations (e.g., network attacks, CSAM, legal requirements).

7.2 Account Restoration and Device Keys

If your account is suspended and later restored (e.g., after resolving a billing issue or addressing a violation), you will receive new per-device cryptographic keys, not your old keys.

This is an architectural requirement of the PALISADE protocol: device keys are ephemeral and tied to active sessions. When your account is suspended, old keys are invalidated for security. Upon restoration, you'll need to re-authenticate your devices to receive new keys.

Practical impact: You'll need to log out and log back in on your devices after account restoration. This takes a few seconds and ensures your connection is secure.

7.3 Your Right to Terminate

You can cancel your account at any time from your account dashboard or by emailingHenry@seraphvpn.com. Cancellation takes effect at the end of your current billing period.

If you delete your account, all your data is permanently deleted within 30 days (see our Privacy Policy).


8. Service Availability

8.1 Uptime

We strive for high availability (targeting 99.9% uptime) but cannot guarantee uninterrupted service. VPN connectivity depends on many factors beyond our control, including your internet connection, local network conditions, and third-party infrastructure.

8.2 Maintenance

We may perform scheduled maintenance that temporarily interrupts service. We'll provide advance notice when possible, but emergency maintenance may occur without warning.

8.3 No Guarantee of Specific Servers

We don't guarantee availability of specific server locations. We may add, remove, or relocate servers to maintain service quality.


9. Privacy and Data Protection

Your use of SeraphVPN is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it—it explains our no-logs policy and commitment to your privacy.


10. Intellectual Property

10.1 Our IP

SeraphVPN, our apps, website, PALISADE protocol specification, and related materials are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse-engineer our software without permission.

10.2 Open Specification

The PALISADE protocol specification is publicly documented for security research and interoperability. However, our implementation and software remain proprietary.


11. Disclaimers and Limitations of Liability

11.1 No Warranties

SeraphVPN is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability or fitness for a particular purpose
  • Uninterrupted or error-free operation
  • Complete security or privacy (though we make strong efforts)
  • Compatibility with all devices or networks

While we use post-quantum encryption and maintain a no-logs policy, no VPN provides absolute security or anonymity. Use SeraphVPN as part of a broader security strategy.

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SeraphVPN and its officers, directors, employees, and agents shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, or goodwill
  • Service interruptions or security breaches
  • Actions of third parties or other users
  • Your use or inability to use the Service

Our total liability to you for all claims arising from your use of SeraphVPN shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Some jurisdictions don't allow exclusion of certain warranties or limitation of liability. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

11.3 Indemnification

You agree to indemnify and hold harmless SeraphVPN from any claims, damages, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any law or third-party rights

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of [Your State/Country], without regard to conflict of law principles.

12.2 Informal Resolution

If you have a dispute, please contact us first at Henry@seraphvpn.com. We'll work in good faith to resolve it informally.

12.3 Arbitration

If we can't resolve a dispute informally, you agree to resolve it through binding arbitration rather than court litigation, except for:

  • Claims in small claims court (if eligible)
  • Injunctive relief to protect intellectual property

Arbitration will be conducted by a neutral arbitrator. Each party bears their own costs, and the arbitrator's decision is final and binding.

12.4 No Class Actions

You agree to resolve disputes individually, not as part of a class or representative action. You waive the right to participate in class actions against SeraphVPN.


13. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we'll notify you via email and update the "Last updated" date at the top.

Continued use of SeraphVPN after changes take effect constitutes acceptance of the new Terms. If you don't agree to changes, you should cancel your account before they take effect.


14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SeraphVPN regarding the Service.

14.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect.

14.3 No Waiver

Our failure to enforce any provision doesn't waive our right to enforce it later.

14.4 Assignment

You may not transfer or assign your rights under these Terms without our consent. We may assign these Terms to a successor or affiliate.

14.5 Force Majeure

We're not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, war, government actions, network failures, etc.).

These Terms are designed to protect both you and us while maintaining the spirit of why we built SeraphVPN: to provide secure, private internet access without surveillance or abuse.

Use the VPN freely. We won't track your usage or impose arbitrary limits. But if you damage our infrastructure or violate the law, we'll take action. That's fair, right?
